A property is said to be a proper one for any mode of transaction, when it holds a good title. Both good title and possession is required for a person, to claim right over a property. When an issue arises in the title over a property, between two contesting parties, a suit for declaration is filed to ascertain and decide the proper title over the said immovable property. It is a common suit filed in India, to decide the proper ownership over the property. Declaration of title is given by the court of law, by way of a decree, assuring the Plaintiff/Defendant to be owner of the said property after verifying the documents submitted in trial by both the claimants to prove the title.
